Foreign Support and Outside Professional Activities.
Several federal agencies have emphasized that failing to disclose foreign relationships and activities could restrict eligibility for future research funding. The National Institutes of Health (NIH), the National Science Foundation (NSF), the Department of Energy (DoE), and the Department of Defense (DoD) have issued notices and directives reminding researchers who have federally-funded projects of their obligation to disclose relationships with and support from foreign entities. Each has different requirements and standards. Although the government has indicated it is in the process of harmonizing federal disclosure requirements and related restrictions, such efforts have not yet borne fruit. Congress is keenly interested in “improper foreign influence” issues as well.
Key information: Increasing Federal attention to lack of transparency in foreign support for academic research as well as economic espionage linked to academic activities, for example:
- Foreign talent programs
- “Gifts”
- Data transfer and data ownership
- Peer review confidentiality violations
- Theft of research support dollars
Know your sponsors’ requirements for conflict of interest and commitment disclosures, and their prohibitions:
- Consider non-traditional forms of support, such as living expenses, gifts
- Travel paid by foreign persons/entities. (Required for PHS funding recipients)
- Be prepared to document all support for research – both foreign and domestic (see, e.g., NSF requirements) (Future proposals may require documentation of current and past support)
- Prohibitions on foreign talent program participation
Disclose potential conflicts on the Conflict of Interest website. Remember that disclosing a potential conflict is not a statement that you have done anything improper.
